Are Poker Home Games Legal?
Question
Does anyone know what the Law says about playing Texas Hold em Poker at home? I was just wondering because every couple of weeks about 15-20 of my co-workers and I get together and have a tourney. It's usually only a $20-$50 buy in. Are we breaking any Laws in doing this?
Answer
The law states it's defensable if it the gambling occures in a private residence, with the exception of luck and skill the odds are the same for each participant, and the the player receives no economical benfit other than the winnings.
What your are doing is absolutely legal. As long as the host, or any other player isn't recieving any percentage of winnings for other reasons besides poker. For example some private games would take 10% of the ante or in the case of hold'em, take a small percentage of the pot.
